  1. 3D Morris - License Agreement for use and distribution
  2.  
  3. This license statement and limited warranty constitutes 
  4. a legal agreement ("License Agreement") between you 
  5. (either as an individual or a single entity) and 
  6. Lobstersoft for 3D Morris ("Software") identified 
  7. above, including any software, media, and 
  8. accompanying on-line or printed documentation.
  9. By installing, copying, or otherwise using 3D 
  10. Morris, you agree to be bound by the terms of this 
  11. Agreement. If you do not agree to the terms of this 
  12. text, do not install or use the 3D Morris
  13.  
  14. 1. DISCLAIMER OF WARRANTY
  15. This software and the accompanying files are sold and 
  16. distributed "AS IS" and without warranties as to 
  17. performance or merchantability or any other warranties
  18. whether expressed or implied.
  19. The author will not be liable for data loss, damages, 
  20. loss of profits or any other kind of loss while using 
  21. or misusing this software.
  22. Limitation of liability to the maximum extent permitted 
  23. by applicable law, in no event shall Lobstersoft or its
  24. suppliers be liable for any special, incidental, 
  25. indirect, or consequential damages whatsoever 
  26. (including, without limitation, damages for loss 
  27. of business profits, business interruption, loss 
  28. of business information, or any other pecuniary 
  29. loss) arising out of the use of or inability to use 
  30. 3D Morris or the provision of or failure to provide 
  31. support services, even if Lobstersoft has been advised 
  32. of the possibility of such damages. 
  33. In any case, Lobstersoft's entire liability under 
  34. any provision of this license agreement shall be 
  35. limited to the greater of the amount actually paid 
  36. by you for the 3D Morris.

  38. 2. LIMITATIONS
  39. You may not reverse engineer, decompile, or 
  40. disassemble the 3D Morris, except and only to the 
  41. extent that such activity is expressly permitted 
  42. by applicable law notwithstanding this limitation.
  43. 3D Morris is licensed as a single product. Its 
  44. component parts may not be separated for use on 
  45. more than one computer.
  46. You may not rent, lease, or lend the registered 
  47. version of 3D Morris.
  48. Any such unauthorized use shall result in immediate 
  49. and automatic termination of this license and may 
  50. result in criminal and/or civil prosecution.

  52. 3. COPYRIGHT
  53. All title and copyrights in and to 3D Morris 
  54. (including but not limited to any images, photographs, 
  55. animations, video, audio, music, text, and "applets" 
  56. incorporated into the 3D Morris), the accompanying printed 
  57. materials, and any copies of 3D Morris are owned by 
  58. Lobstersoft. 3D Morris is protected 
  59. by copyright laws and international treaty provisions. 
  60. Therefore, you must treat 3D Morris like any other 
  61. copyrighted material.You may not copy the printed materials
  62. accompanying 3D Morris. 
  63. The unregistered shareware version of 3D Morris, may be 
  64. freely distributed, provided the distribution package 
  65. is not modified. So please give shareware version of 
  66. 3D Morris to everybody that is interested in this 
  67. kind of software.

  70. 4. EVALUATION LICENSE
  71. Anyone may use this software during a test period of 
  72. 15 days of usage. If you wish to continue to use 3D 
  73. Morris after this period, you MUST register.
  74. Unregistered use of 3D Morris after the 15-day 
  75. evaluation period is a violation of U.S. and 
  76. international copyright laws.

  78.  5. REGISTERED VERSION LICENSE
  79. Once registered, the user is granted a non-exclusive 
  80. license to use 3D Morris on one computer (i.e. a 
  81. single cpu), for any legal purpose, at a time. 
  82. The license of 3D Morris may be permanently transferred,
  83. if the person receiving it agrees to terms of this 
  84. license. If the software is an update, the transfer 
  85. must include the update and all previous versions.

  87. 6. MISCELLANEOUS
  88. All rights not expressly granted here are reserved 
  89. by Adrian Grigore.

  93. Since you're about to intall a Cydoor enabled application,
  94. you must read and accept the following -

  96. Cydoor Technologies Ltd. Software End User License Agreement
  97.  
  98. By clicking on the "Yes" button, you are consenting to be 
  99. bound by and are becoming a party to this agreement. If you 
  100. do not agree to all of the terms of this agreement, click 
  101. the "Do not accept" button.

  103. 1. Definitions:
  104.  
  105. (a) "Cydoor Software" means the software program covered by 
  106.     this Agreement, and all related updates supplied by 
  107.     Cydoor Technologies.
  108.  
  109. (b) "Cydoor Product" means the Cydoor Software and any 
  110.     related documentation, models and multimedia content 
  111.     (such as animation, sound and graphics), and all related 
  112.     updates supplied by Cydoor Technologies Ltd (follows:
  113.     "Cydoor").

  115. Upon acceptance of this agreement, Cydoor Technologies grants 
  116. to you a non-exclusive license to use the Software, provided 
  117. that you agree to the following:

  119. 2. License Grant:
  120.  
  121. You may install the Software on a hard disk or other storage 
  122. device; install and use the Software on a file server for use
  123. on a network for the purposes of (i) permanent installation 
  124. onto hard disks or other storage devices or (ii) use of the 
  125. Software over such network; and make backup copies of the 
  126. Software.
  127.  
  128. You may make and distribute unlimited copies of the Software, 
  129. excluding copies for commercial distribution, as long as each 
  130. copy that you make and/or distribute is subject to this 
  131. Agreement, and the same copyright and other proprietary 
  132. notices pertaining to this Software that appear in the 
  133. Software. If you download the Software from the Internet or 
  134. similar on-line source, you must include the Cydoor
  135. copyright notice for the Software with any on-line 
  136. distribution and on any media you distribute that includes 
  137. the Software.

  139. This License does not entitle you hard-copy documentation, 
  140. support or telephone assistance. Cydoor reserves the right 
  141. at any time not to release a commercial release of the 
  142. Software or, if released, to alter prices, features, 
  143. licensing terms, or other characteristics of the commercial 
  144. release.

  146. 3. Restrictions:
  147.  
  148. You may not permit other individuals to use the Software 
  149. except under the terms listed above.  You may not copy the 
  150. Software other than as specified above.  You agree not to 
  151. modify, adapt, translate, reverse engineer, decompile, 
  152. disassemble or otherwise attempt to discover the source code 
  153. of the Software (except and solely to the extent an 
  154. applicable statute expressly and specifically prohibits such 
  155. restrictions). You may not modify, rent, lease, resell for 
  156. profit, distribute or create derivative works based upon the 
  157. Cydoor Product or any part thereof.  You may not grant a 
  158. security interest in, or otherwise transfer rights to the 
  159. Software.  You may not remove any proprietary notices or 
  160. labels on the Software.

  162. 4. Disclaimer of Warranty:
  163.  
  164. The software is provided on an "as is" basis, without 
  165. warranty of any kind from Cydoor, express or implied, 
  166. including without limitation warranty of merchantability, 
  167. free of defects, fitness for a particular purpose and 
  168. non-infringement of third party rights. The entire risk as to 
  169. the quality and performance of the software is borne by you. 
  170. Should the software prove defective in any respect, you and 
  171. not Cydoor or its suppliers assume the entire cost of any 
  172. service and repair. 
  173.  
  174. This disclaimer of warranty constitutes an essential part of 
  175. the agreement. No use of the software is authorized hereunder 
  176. except under this disclaimer.
  177.  
  178. In no event will Cydoor be liable to you for consequential, 
  179. incidental, special or exemplary damages arising out of a 
  180. breach of this agreement or warranty or your use of the 
  181. software, including but not limited to lost profits or loss 
  182. of business, even if Cydoor has been apprised of the 
  183. likelihood of such damages occurring.

  185. Cydoor shall have no obligation to you with respect to any 
  186. claim of infringement based upon your use of the software in 
  187. combination, operation or otherwise with the data or 
  188. materials not supplied by Cydoor.
  189.  
  190. 5. Downloading Additional Software:
  191.  
  192. In the event that your computer lacks software necessary for 
  193. the Software to operate, a message will automatically be sent 
  194. by the Software to Cydoor that additional software is needed.
  195. Cydoor will then send you the additional software required 
  196. for operation of the Software.  By accepting this Agreement, 
  197. you agree that the Software and any additional software 
  198. needed will be downloaded into your computer.

  200. 6. Termination:
  201.  
  202. This Agreement and the license granted hereunder will 
  203. terminate automatically if you fail to comply with the 
  204. limitations described herein. Upon termination, you must 
  205. destroy all copies of the Software and Documentation.
  206.  
  207. 7. Privacy Act:
  208.  
  209. This Agreement is subject to the Israeli Privacy Act of 1981.
  210. Cydoor shall neither attain nor use any of your identifying
  211. characteristics. In addition, Cydoor will not obtain any 
  212. personal information that could identify you including your
  213. name, picture or voice in order to match said personal 
  214. characteristics to the information in the registration form.
  215. Nevertheless, by accepting this software, you hereby 
  216. authorize Cydoor to use the information in your 
  217. registration form when selecting advertisements for you. 
  218. Cydoor will use the information in the registration form
  219. provided by you solely for the purpose of selecting which
  220. commercials may, in Cydoor opinion, interest you most.

  222. By downloading the Cydoor Product, you are confirming your
  223. acceptance of the Software and agreeing to be bound by the
  224. terms of this Agreement.
  225.  
  226. 8. General:
  227.  
  228. This Agreement shall be governed by the laws of the State of
  229. Israel. This Agreement contains the complete agreement 
  230. between the parties with respect to the license granted 
  231. hereunder and supercedes all prior or contemporaneous 
  232. agreements or understandings, whether oral or written.
  233. This Agreement may be amended only by a writing signed by an 
  234. authorized officer of Cydoor.
  235.  
  236. This Agreement will not be governed by the United Nations
  237. Convention on Contracts for the International Sale of Goods,
  238. the application of which is expressly excluded.  You agree
  239. that the Software will not be shipped, transferred or
  240. exported into any country or used in any manner, directly or
  241. indirectly, prohibited by the United States Export 
  242. Administration Act or any other export laws, restrictions or
  243. regulations.

  245. If any provision of this Agreement is held to be void and 
  246. unenforceable, it will not affect the validity of the balance
  247. of the Agreement.  Such provision shall be reformed only to
  248. the extent necessary to make it enforceable. This Agreement 
  249. shall be governed by Israeli law, excluding conflict of law 
  250. provisions (except to the extent applicable law, if any, 
  251. provides otherwise).
